General Terms and Conditions of Sale

1. Identity of the lessor

These General Terms and Conditions of Sale (“GTCS”) govern bookings made with:

By confirming a booking, the guest acknowledges having read and accepted these GTCS.

2. Description of the accommodations

The lessor offers furnished holiday rentals located in MUNTZENHEIM (68320), each including a private wellness area with spa.

The property currently comprises 8 accommodation(s) with a capacity of de 4 à 6 personnes.

A detailed description of each accommodation (photos, equipment, maximum capacity, etc.) is available on the booking website. In case of discrepancy, the information shown online at the time of booking shall prevail.

3. Booking and payment

All bookings are made online via a secure booking system (Beds24), with payment by bank card through the payment provider Stripe.

The total amount of the stay is payable in full at the time of booking. The booking becomes firm and final once the payment has been successfully processed.

Payment is made exclusively by bank card. Other payment methods (cash, cheques, holiday vouchers, etc.) are not accepted unless expressly agreed in writing by the lessor.

The guest declares that they are of legal age, legally capable of entering into a contract and using a bank card for which they are the holder or duly authorised user.

4. No right of withdrawal

In accordance with French Consumer Law (article L.221-28), accommodation services provided on a specific date or for a specific period are not subject to the statutory right of withdrawal. As a result, no right of withdrawal applies to bookings made.

5. Cancellation policy

In case of cancellation by the guest, the following conditions apply:

  • Up to 30 days before arrival: refund of 50% of the amounts paid.
  • Less than 30 days before arrival: no refund will be made.

Cancellation requests must be sent by email to the contact address indicated above. The date on which the request is received by the lessor will be taken as proof.

In the event of circumstances invoked by the guest as force majeure (illness, impediment, etc.), the above conditions remain applicable and no specific refund is provided for, without prejudice to a possible commercial gesture at the sole discretion of the lessor.

6. Security deposit and damage guarantee

When paying for the stay, the guest’s bank card is securely registered by the payment provider Stripe in accordance with current security standards (including PCI-DSS).

This card serves as a payment guarantee to cover any damage caused to the accommodation, its equipment, the spa or the common areas. No security deposit amount is automatically debited or blocked at the time of booking.

In the event of proven damage, deterioration, excessive cleaning, clear breach of the house rules or abnormal use of the facilities (in particular the spa), the lessor reserves the right to debit an amount of up to 500 € from this card, within a period of 7 days following the guest’s departure.

Wherever possible, the guest will be informed beforehand by email and/or phone of the amount envisaged and the reasons (photos, report, estimates, etc.). An invoice or receipt will be provided on request.

The security deposit does not limit the guest’s liability: if the total amount of the damage exceeds the above maximum, the lessor may claim the balance by any lawful means (insurance, amicable recovery, legal action).

7. Insurance

The lessor declares having taken out a non-occupant homeowner insurance policy for the accommodations offered for rent.

Guests are strongly advised to hold a personal civil liability insurance policy covering any damage they may cause to the accommodation and to third parties, including in the context of a holiday rental. This guarantee is usually included in their main home insurance.

8. Check-in, check-out and keys

Unless otherwise stated, check-in is from 5:00 p.m. and check-out must take place no later than 11:00 a.m..

After booking, the guest receives by email or via the welcome guide the information needed to access the accommodation (including, where applicable, the key box code and entry instructions). The guest is responsible for reading these instructions before arrival.

The accommodation must be left in a reasonable state of cleanliness. A list of tasks to be completed before departure (dishes, tidying up, bins, etc.) is provided in the guest guide.

9. House rules and spa use

The guest agrees to comply strictly with the house rules displayed in the accommodation and provided in the welcome guide, as well as with the specific instructions relating to the spa and wellness area.

  • Parties and loud events: not allowed, unless expressly agreed in writing by the lessor.
  • Maximum capacity: 4 people for most accommodations and up to 6 people for the spa loft. It is strictly forbidden to exceed the stated maximum capacity.
  • Pets: allowed provided they do not cause any nuisance (excessive noise, damage, dirt). Pets are strictly forbidden in the spa.
  • Smoking / vaping / shisha: allowed outdoors only (terrace or designated outdoor areas) using the ashtrays provided. Smoking inside the accommodation is strictly forbidden.
  • Spa and wellness area: use is allowed 24/7 under the guest’s sole responsibility, in strict compliance with the instructions (hygiene, safety, noise control, covering the spa after use, etc.) set out in the house rules and spa guidelines.

Any serious breach of these rules may result in additional charges, deduction of all or part of the security deposit and, in case of grossly inappropriate behaviour, the immediate termination of the stay without any refund.

10. Liability

The guest is liable for all damage, deterioration, loss and nuisance caused by themselves or by the persons accompanying them (including pets) in the accommodation, common areas and facilities made available.

The lessor cannot be held liable in case of service interruptions in public networks (water, electricity, internet, etc.), disturbances arising from the surroundings (outside noise, works, neighbourhood, weather, etc.) or any event constituting a case of force majeure.

11. Personal data

Personal data collected (name, contact details, booking information, etc.) are used solely for managing bookings, invoicing, communication regarding the stay and, where applicable, for requesting a review after the stay (for example via Google).

Payment data are processed exclusively by Stripe and are never stored in plain text by the lessor.

In accordance with applicable regulations, the guest has the right to access, rectify and delete their personal data, which they may exercise by contacting the lessor at the email address indicated in section 1.

12. Governing law and jurisdiction

These General Terms and Conditions of Sale are governed by droit français. In case of dispute and failing amicable settlement, jurisdiction is assigned to the competent courts of les tribunaux du ressort de Colmar.

In case of discrepancy between the French and English versions of these GTCS, the French version shall prevail.

13. Acceptance of the GTCS

By confirming an online booking and payment, the guest fully and unreservedly accepts these General Terms and Conditions of Sale.
